CANADIAN GUARANTEE

The purchaser understands that, even though the parents of this dog have been cleared for hip dysplasia and inherited eye disease and the breeders have made the greatest effort to avoid the risk of genetic problems, there is no method to guarantee that this dog will be free of all congenital or genetic disease.

We, the undersigned, agree to the following terms and conditions of sale.

  1. This dog is guaranteed until the age of 26 months against any major genetic or congenital defects. If, during this period, any such defects are found and confirmed by a second veterinarian of the breeder's choice, the purchaser shall have the following options.
    1. Purchaser may return the dog in exchange for a dog from the next available litter.
    2. Upon proof on neutering of the affected dog, the purchaser shall be entitled to a pup from the next available litter, while retaining possession of the affected dog.
    3. In either of the above cases, the seller will not be liable for any expenses incurred as a result of such defects unless prior arrangements have been made, in writing, by both parties. The maximum delay in taking possession of the replacement dog shall be 24 months.
  2. The above dog shall not be used for breeding purposes until the hips have been certified clear by OFA, OVC, PennHip or other widely recognized registry and the eyes have been cleared by a veterinary opthamologist. The dog must be at least 18 months of age. In order to enforce these conditions, the following clauses apply:
    1. The breeders must be provided with copies of above certifications.
    2. If the dog is used for breeding contrary to the above conditions, all guarantees shall be null & void.
    3. Each time the above dog is used for breeding contrary to the above stipulations, the registered owner(s) shall pay a penalty of $1000.00 to the breeders unless prior arrangements have been made, in writing, by both parties.
  3. The above dog cannot be sold or given to anyone without prior consultation with the breeders, who reserve the right to be provided with the full name and address of the new owner. Unless the above dog has been neutered, the new owner must sign a contract containing all of the clauses in 2 (a)(b)(c). A copy of the new contract and/or certificate of sterilization must be sent to the breeders.
  4. The above dog will be individually registered with the Canadian Kennel Club (CKC) at the expense of the breeder. The registration certificate will be forwarded to the purchasers as soon as received from the CKC, except when full payment for the dog or any purchased and/or loaned accessories has not been received by the breeder.
  5. The above dog must not be surrendered to any SPCA, Humane Society or other organization without express written consent from the breeders. If the dog cannot be kept by the purchasers, the breeders must be contacted and will try to make arrangements for placement. The dog may be returned to the breeders at anytime. Any transportation costs will be a the buyer's expense. No refund will be made.
